FallenSword Usage Agreement

The term "player" includes any person or entity using the service, as well as any person or entity acting on behalf of such person or entity in relation to using the service.

Any player, by using our service agrees to be bound by the terms and conditions of this agreement.

You must be 13 years or older to create and/or use a Fallen Sword game account. If you are under 18, you must have permission from your legal guardian or parents to create an account and play Fallen Sword. If we feel this approval has not been given, we reserve the right to terminate the account without notice.

Player shall use the Service in compliance with all applicable local, state, national, and international laws, rules and regulations.

A player shall not transmit through the Service any unlawful, harassing, defamatory, libelous, slanderous, disparaging, privacy invading, abusive, threatening, harmful, misleading, obscene or otherwise objectionable material of any kind.

A player shall not transmit "junk mail", "spam", "chain letters", or unsolicited mass distribution on board posting or on private messages.

The player agrees that he/she is solely responsible for all actions that occur under his account.

Any opinions expressed by a Player on the boards and on private messages are those of the Player alone, and are not to be attributed to Hunted Cow Studios Ltd.

Hunted Cow Studios Ltd cannot and does not assume responsibility for the accuracy, completeness, safety, timeliness, legality or applicability of anything said or written by any Player. Hunted Cow Studios Ltd cannot control the information provided by Players. Players' information might be offensive, harmful, untimely, inaccurate and/or deceptive and, accordingly, you agree to exercise caution, discretion and common sense when using the Service.

The player agrees that he/she is solely responsible for any damages done to his computer or data loss by using our service.

Hunted Cow Studios Ltd makes no warranty that the service will be uninterrupted, secure or error free.

Promoting any game which is not owned by Hunted Cow Studios Ltd. is not permitted. This includes, but is not limited to, links within a post, avatars, signature images or text and in game messages.

Negative comments regarding the costs, or any other game related charges are not allowed.

Game bugs should be reported directly via our support centre (http://support.huntedcow.com). You may, however, also post bugs in the Bugs Forum in order to ascertain whether what you experienced is, in fact, a bug.

Bugs which are a potential exploit to the game should not be posted publicly. They should be brought to the immediate attention of Hunted Cow Studios Ltd via our support centre (http://support.huntedcow.com).

Hunted Cow Studios Ltd may, at their disgression, terminate any game account with or without notice, without disclosing a reason for doing so. Under these circumstances any remaining time or services paid for will become null and void and any items on the character will be deleted.

You may not advertise the intent to or commit the act of buying, selling, trading, sharing, or transferring access to any Fallen Sword account, Fallen Sword points or any commodities within the game. (All characters and items are the property of Hunted Cow Studios Ltd.)

The player agrees that he is not eligible for refunds under any circumstances.

Hunted Cow Studios Ltd. reserves the right in its sole discretion to modify or discontinue the Service or modify the terms and conditions of Players' access to the Service, without notice to Players, and shall not be liable to the player or any third party for doing so. All the accounts created are the property of Hunted Cow Studios Ltd.

The player agrees to indemnify Hunted Cow Studios Ltd. against liability for any use of his account

The player agrees that no information obtained from Hunted Cow Studios Ltd. and/or Hunted Cow Studios Ltd. team, whether it is oral or written, will create any warranty.

Hunted Cow Studios Ltd. may, at any time, modify any of the terms and conditions contained in this agreement with or without notice. If you do not agree to the changes, your only remedy is to discontinue use of the service. Your continued use of the service will constitute binding acceptance of the new agreement.

If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be deemed superseded by a valid enforceable provision that most closely matches the intent of the original provision and the remaining provisions shall be enforced. Hunted Cow Studios Ltd's failure to act with respect to a breach by Player or others does not waive Hunted Cow Studios Ltd 's right to act with respect to subsequent or similar breaches. The failure of Hunted Cow Studios Ltd to exercise or enforce any right or provision of these terms and conditions shall not constitute a waiver of such right or provision.

This Agreement constitutes the entire agreement between Hunted Cow Studios Ltd. and Player with respect to the subject matter hereof. By a player’s use of the service the player agrees that this agreement shall be governed by the Law of Scotland and accepts that the Sheriff Court of Elgin shall be the appropriate jurisdiction for any such disputes.
